Registered Users may publish User Content where the relevant feature allows this, for example through comments, Q&A, group posts, profile submissions, event submissions, suggestions or other interactive features.
By publishing User Content, the User grants Liver & Heart a non-exclusive, transferable, sub-licensable, worldwide and royalty-free license to use the User Content for the operation, provision, moderation, improvement and promotion of the Services. This includes the right to store, copy, reproduce, display, publish, make publicly available, edit, format, translate, excerpt and technically adapt the User Content.
This license remains valid for as long as necessary to provide the Services, comply with legal obligations, preserve platform integrity, maintain discussions or document moderation decisions. Statutory rights of deletion, withdrawal or objection under data protection law remain unaffected.
The User guarantees that they hold all rights necessary to publish the User Content and to grant the above license.

Community features are intended for respectful exchange, education and orientation. They are not intended for emergency care, diagnosis, prescription, individual treatment instructions or replacement of medical consultation.
Users must not request or provide individualized diagnosis, dosing instructions, prescription advice or emergency medical guidance through community features.
Experts may contribute educational information, general explanations or professional perspectives. Unless a separate doctor-patient relationship is expressly established outside the platform, such contributions do not create an individual treatment relationship.
Liver & Heart may apply moderation, reporting, review, escalation, expert verification, content labeling or safety mechanisms. Liver & Heart does not guarantee that all Content is reviewed before publication.
9. Expert Profiles and Professional Content

14. Events, Programs and External Services
Liver & Heart may list, host, promote or facilitate events, webinars, live sessions, replays, programs, screening pathways, partner services or third-party offerings.
Unless expressly stated otherwise, third-party services are provided by the respective third party, not by Liver & Heart. Separate terms, privacy notices, eligibility criteria, medical consent forms, payment terms or professional rules may apply.
Liver & Heart is not responsible for the availability, quality, medical suitability, professional conduct or outcome of third-party services, unless mandatory law provides otherwise.
Event times, speakers, topics, availability and formats may change. Liver & Heart may cancel, postpone or modify events where necessary.
15. Data Protection and Privacy

- interfere with platform security, availability or integrity.
17. Abuse, Reporting and Moderation

Liver & Heart may take appropriate action, including review, removal, restriction, warning, suspension, termination, escalation or notification to competent authorities where required.
18. Availability of the Services
Liver & Heart aims to provide reliable access to the Services. However, restrictions or interruptions may occur due to technical conditions, maintenance, internet infrastructure, third-party services, security measures, force majeure or circumstances outside Liver & Heart's control.
Liver & Heart may temporarily restrict access to the Services for maintenance, updates, security measures or operational reasons.
Unless otherwise agreed in a separate paid enterprise or organization agreement, Liver & Heart does not guarantee uninterrupted availability of the Services.
19. Liability
Unless otherwise provided in these Terms, Liver & Heart shall be liable for damages only in cases of intent or gross negligence.
In cases of simple negligence, Liver & Heart shall be liable only for injury to life, body or health, or for breach of an essential contractual obligation. Essential contractual obligations are obligations whose fulfillment is necessary for the proper performance of the contract and on whose compliance the User may regularly rely.
In the event of a slightly negligent breach of essential contractual obligations, Liver & Heart's liability shall be limited to the typical and foreseeable damage at the time of conclusion of the contract.
The above limitations of liability also apply in favor of Liver & Heart's legal representatives, employees and agents.
Liability under mandatory statutory law, including product liability law, remains unaffected.
20. Intellectual Property Rights
The User acknowledges that the name, trademarks, logos, design, software, databases, artwork, text, graphics, interfaces, workflows and other intellectual property of Liver & Heart are valuable assets of SPOTIC GmbH or its licensors.
Except as expressly permitted under these Terms, Users may not use Liver & Heart's name, trademarks, logos, design, software or other protected materials without prior written consent.
Content made available on Liver & Heart may be protected by copyright, database rights, trademark rights or other intellectual property rights. Users may access and use such Content only for personal, professional or organizational purposes within the intended functionality of the Services.
21. Feedback
Users may provide suggestions, comments, ideas or other feedback regarding the Services. Liver & Heart may freely use, exploit, modify and further develop such feedback without restriction or compensation, provided that personal data is handled in accordance with applicable data protection law.
22. Changes to the Services and Terms
Liver & Heart continuously develops and improves the Services. This may require changes to these Terms.
Liver & Heart may amend these Terms where changes are necessary due to legal, technical, economic or functional developments, new features, regulatory requirements, security needs or changes in the Services.
Unless a shorter period is legally permitted or required, Liver & Heart will inform registered Users of material changes at least 14 days before they take effect.
Continued use of the Services after the effective date of the amended Terms shall be deemed acceptance, unless mandatory law requires explicit consent.
23. Termination
Users may stop using the Services at any time.
Registered Users may delete their Account or terminate paid Subscriptions in accordance with the cancellation options provided on the platform or in the applicable Subscription terms.
Liver & Heart may terminate or suspend access if a User materially violates these Terms, fails to pay fees, misuses the Services, infringes rights, creates safety risks or violates applicable law.
Termination does not affect rights and obligations that by their nature continue after termination, including payment obligations, license rights already granted where necessary, liability provisions, intellectual property rights and legal retention obligations.
24. Final Provisions
These Terms are governed by the laws of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods. Mandatory consumer protection laws of the country in which a consumer has their habitual residence remain unaffected.
If the User is an entrepreneur within the meaning of Section 14 of the German Civil Code, the place of jurisdiction for all disputes arising from or in connection with these Terms shall be Berlin, Germany, unless mandatory law provides otherwise.
If any provision of these Terms is or becomes invalid, the validity of the remaining provisions shall remain unaffected.
